The phases, the LLCs and the power plant

What the agendas show

Across 2025 and into 2026, Abilene City Council took up a data centre campus repeatedly — usually first in closed session under Texas Government Code § 551.087, the business-prospect exception, and then in open session as votes on tax abatement agreements, site infrastructure agreements and zoning.

The operator named throughout is Lancium. The counterparties are numbered companies: Abilene DC 1 and DC 3 through DC 10, each tied to a numbered Phase. There is also Abilene DC TPP, LLC, which the City’s own agenda describes in parentheses as an Electricity Generation Plant.

The single most specific item

4 December 2025, item 17. Tax abatement agreements and second tax abatement agreements with “Lancium LLC and Abilene DC 9, LLC (Phase 9), … Abilene DC 10, LLC (Phase 10), and Abilene DC TPP, LLC (Electricity Generation Plant).” The same meeting created Reinvestment Zone No. RZ25-1, approximately 614.91 acres.

What we notice, and what we do not claim

Two things stand out on the face of the record, and neither is an accusation.

There is a generation plant in the deal. A campus large enough to need its own electricity generation entity is a different proposition for a city than a warehouse, and it raises ordinary questions about power, water and who carries the cost of the connection. The agreements answer those questions. They are public records.

The numbering skips two. The companies run DC 1 and DC 3 through DC 10, plus DC TPP. In the agendas indexed so far, DC 2 does not appear. That may mean nothing — entities get renamed, merged, or never formed — and we are not going to guess. It is noted because it is the kind of gap one request resolves in a line.

We are not alleging that anything here was improper. Tax abatements, Chapter 380 agreements, reinvestment zones and § 551.087 closed sessions are ordinary, lawful instruments used by cities across Texas, and attracting investment is a legitimate thing for a council to do. The point is narrower: the negotiations happened in closed session and the resulting agreements are public. A resident is entitled to read what the City actually agreed to.

The same tool, at two very different sizes

Chapter 380 is worth understanding because Abilene uses it at both ends of the scale. The statute that appears beside these projects also appears in agreements with individual homebuilders under the City’s ReBuild ABI programme — single addresses on Peach Street and Minda Street. One instrument, a homebuilder at one end and a multi-company campus with its own power plant at the other. Reading both tells you more than reading either.

What we are asking for

  1. The executed tax abatement agreements and second agreements named in the 28 August and 4 December 2025 items, in full, with all exhibits.
  2. The Site Infrastructure Agreements with Abilene DC9 and DC10 approved 8 January 2026.
  3. The ordinance and boundary description for Reinvestment Zone RZ25-1.
  4. Any water supply or utility service agreement referenced by those agreements, and the projected water demand relied on by the City.
  5. The certified agenda or tape of the § 551.087 sessions, which Texas requires a governmental body to keep.
